Commercial Developments, Land Divisions and Condominium Plan Approval
If a review of stormwater runoff management is requested by the local
government agency the Drain Commissioner will perform a review based on
these rules and regulations. The Drain Commissioner may hire a
registered engineer to advise in the review. The added cost of hiring an
engineer will be reflected in the fee. The Owner/Developer of the land
development project will submit a set of construction plans and
calculations to the Drain Commissioner in accordance with these rules
and regulations.
A land development project will be reviewed and subject to the
Construction Plan submittal
requirements, Hydrology and
Hydraulic Calculations,
Accepted Coefficiency Factors and
Deed Restrictions of the rules and regulations. After the review the
Drain Commissioner will determine if the drainage facilities should be
dedicated through a 433 Agreement to the
Drain Commissioner or remain private. If the drainage facilities are to
remain private or under the control of a municipality other than the
Drain Commissioner, a written, signed and recorded document accepting
full liability and responsibility for all drainage facilities by the
developer and/or municipality may be required. Copies of this document
will need to be submitted to the Drain Commissioner and the municipality
requesting the review.
The review by the Drain Commission will be completed within thirty
(30) days of receiving the necessary construction plans and
calculations. A written review with recommendations will be sent to the
Owner/Developer and the municipality requesting the review. The
municipality can then enforce or reject the Drain Commissioner’s
recommendations.
The fee for review will be paid to the Calhoun County Drain
Commissioner by the local municipality. The fee shall be submitted with
the written request for review. If a consulting engineer is required to
review the construction plans that cost will be paid by the local
municipality before issuance of review letter.
As-built construction plans must be submitted to the Calhoun County
Drain Commissioner upon completion of project if a 433 Agreement is to
be implemented.
