Calhoun County Agricultural Preservation Board
August 21, 2006
Meeting Minutes
A special meeting of the Calhoun County Agricultural Preservation
Board (APB) was held on Monday, August 21, 2006, at 3:00 p.m., in the
Planning Department Conference Room, County Building, Marshall,
Michigan.
Chair Matt Davis called the meeting to order at 3:13 p.m. and led the
group in the Pledge of Allegiance. Roll was called with the following
members present: Wayne Cornell, Ben Lark, Greg Moore, and Matt Davis.
Members absent: Nancy Deitz, and Ken Blight.
Also present were: Jennifer Bomba, County Land Use Consultant.
Meeting Minutes
Moved by Wayne Cornell, supported by Greg Moore to approve the
July 10, 2006 meeting minutes as presented. Motion carried.
Old Business
Repurchase Provision: Ms. Bomba indicated that she met
with Ms. Nancy Mullett, legal counsel for the County, regarding the
repurchase of development rights. Ms. Mullett indicated that the Calhoun
County Farmland Preservation Ordinance is sufficient and complies with
the state zoning enabling act. Her interpretation of the language
concludes that eminent domain is our provision for buyback. Ms. Mullett
also noted that she did not believe the ordinance required amending to
clarify our compliance with other regulations on this issue.
New Business
Membership: The County Board of Commissioners approved
the proposed amendments to the farmland preservation ordinance at their
meeting on August 17, 2006. This paves the way for us to fill the long
standing vacancy for the position of a township representative. Jennifer
presented the county’s application as well as the one developed by the
Planning Department for the initial appointments to the APB. The group
agreed that we should use the county’s application so as not to confuse
applicants. The possibility of a press release in the Shopper or Advisor
was discussed. Jennifer will send a letter/memo to townships seeking a
new member.
The position held by Nancy Dietz was discussed. Jennifer has not been
able to speak with Ms. Dietz about her possible resignation, but will
continue to make contact with her.
Moved by Greg Moore, supported by Ben Lark that pursuant to the
by-laws of the Agricultural Preservation Board (APB) regarding
attendance and pending a letter of resignation from Ms. Nancy Dietz,
the APB hereby removes Nancy Dietz from membership on the Agricultural
Preservation Board. Motion carried.
If a letter of resignation is received from Nancy, Jennifer will
advertise the agricultural interest vacancy at the same time as the
township representative position.
Township Resolutions: Jennifer reminded members that in
order to begin the application cycle we are required by PA 262 and the
county farmland preservation ordinance to have resolutions of support
from townships regarding the PDR program. Without resolutions landowners
are not eligible to make application to the program. Jennifer presented
a sample resolution and a letter that will be sent out to all townships
explaining the need for the resolutions.
PDR Application: Jennifer has been working on an
application that is very detailed and does a lot of the scoring as data
is entered. However, she is experiencing some difficulty with an error
and is not able to present it today. Jennifer will work on the issues
and present the application at the next meeting.
Staff Comments
Land Use Tour: Jennifer informed the APB that she is
still not making any progress with The Andersons regarding our interest
in holding the annual land use tour at the ethanol facility. Other
possibilities were discussed, including Bosserd’s Farm. Jennifer will
keep working to see if it can still happen yet this year.
Member Comments:
Greg Moore discussed an article he recently read regarding wine
country in Oregon and the positive impact that preservation has had on
the land values.
With no further business, the APB adjourned at 4:04 p.m.
