Planning Commission Meeting Minutes
CALHOUN COUNTY METROPOLITAN PLANNING COMMISSION
January 22, 2007
The Regular Session of the Calhoun County Metropolitan Planning
Commission convened at 4:02 p.m., Monday, January 22, 2007 in the
Planning Office Conference Room, Calhoun County Building, 315 West Green
Street, Marshall, Michigan.
Roll Call: Present: Comrs. Daniel Kesselring, Dian Schubel, Robert
Bolton, Clarence Millard. Temporarily Excused: Comr. Larry Rizor
(Arrived at 4:09 p.m.). Absent: Comr. Betty Arnquist.
Also Present: Planning Consultant Jennifer Bomba and Deputy
Clerk/Board Aide Mary Lou Barrett.
SPECIAL ORDER OF BUSINESS:
Election of 2007 Officers
Planning Consultant Bomba inquired if there were any nominations.
Comr. Millard nominated Dian Schubel for the Office of Chairperson of
the Calhoun County Metropolitan Planning Commission for 2007. Comr.
Schubel stated that it might be a bit difficult this year with her
parents, however, accepted the nomination. Comr. Bolton nominated Daniel
Kesselring for the Office of Vice Chairperson of the Calhoun County
Metropolitan Planning Commission for 2007. Comr. Kesselring accepted the
nomination.
"Motion by Comr. Bolton, supported by Comr. Millard, adopt the
following: Resolved by the Calhoun County Metropolitan Planning
Commission close nominations for the Office of Chairperson and Vice
Chairperson of the Calhoun County Metropolitan Planning Commission for
2007; and elect by unanimous vote, Dian Schubel Chairperson of the
Calhoun County Metropolitan Planning Commission for 2007 and Daniel
Kesselring Vice Chairperson of the Calhoun County Metropolitan
Planning Commission for 2007."
Voice Vote: Motion CARRIED
APPROVAL OF AGENDA:
"Motion by Comr. Kesselring, supported by Comr. Millard, adopt the
following: Resolved by the Calhoun County Metropolitan Planning
Commission approve the January 22, 2007 agenda, as amended, to include
Item. Nos. 10. C. - Case No. 01-07-03 Tekonsha Township - Text
Amendment, and 10. D. - Case No. 01-07-04 Clarendon Township - Zoning
Amendment Change."
Voice Vote: Motion CARRIED
APPROVAL OF MINUTES:
"Motion by Comr. Kesselring, supported by Comr. Millard, adopt the
following: Resolved by the Calhoun County Metropolitan Planning
Commission approve the November 27, 2006 minutes as presented."
Voice Vote: Motion CARRIED
COMMUNICATIONS:
Ms. Bomba presented the following communication:
- 2006 Annual Address Summary
Ms. Bomba stated that the summary reflects the total number of
address permits for the year. Ms. Bomba advised that the data is used by
the Agricultural Preservation Board to determine areas of development.
Comr. Kesselring stated that the data might be more meaningful if
the acreage for each permit was provided.
TOWNSHIP PLANNING AND ZONING COORDINATION:
Case #01-07-01, Eckford Township - PA 116 Application, Section
24
Ms. Bomba advised that the Eckford Township Planning Commission has
submitted a farmland agreement application for Wayne Cornell for
approximately 62 acres of cultivated land and 31 acres of woodlands,
farm lanes, etc. located in Section 24 of the Township. The property
consists of 15 buildings including a residence, 9 barns, a tool shed, a
silo, a grain storage facility and a milking parlor. The property owner
has requested a ten year agreement. Ms. Bomba stated that the
application is valid and recommended that it be recommended for approval
by the Michigan Department of Agriculture.
"Motion by Comr. Rizor, supported by Comr. Millard, resolved by the
Calhoun County Metropolitan Planning Commission adopt the following:
WHEREAS, the Calhoun County Metropolitan Planning Commission
believes the PA 116 Farmland and Open Space Preservation Program
Application for Farmland Agreement submitted by Wayne Cornell for
approximately 93 acres located in Section 24 of Eckford Township is
valid.
BE IT RESOLVED, that Calhoun County Metropolitan Planning
Commission recommend approval of the application by the Michigan
Department of Agriculture."
Voice Vote: Motion CARRIED
Case #01-07-02, Marshall Township - Map Amendment, Section 14,
Agricultural Residential to Highway Service Commercial
Ms. Bomba advised that the Marshall Township Planning Commission
received a request from Cecil Farmer to rezone approximately 1.5 acres
located in Section 14 from agricultural residential to highway service
commercial. The property is located north of Old 27 and the I-94
interchange on the west side of the highway. Ms. Bomba advised that all
of the land to the east and west shall remain agricultural residential.
Ms. Bomba advised that the request for rezoning is consistent with the
Township's Master Land Use Plan and recommended approval of the rezoning
request.
Brief discussion regarding Mr. Farmer's future intentions to split
his property and the creation of a road.
Comr. Kesselring questioned the PA 425 agreement listed on the map.
Ms. Bomba advised that the land is annexation land where Marshall City
and the Township have an agreement should the land be developed. Ms.
Bomba stated that the Smith property is in a 50 year agreement, and that
the City and Township would share the mill of taxes on that property.
Ms. Bomba advised that the Township would lose some control over the
land, however, would pay less for maintaining it.
"Motion by Comr. Rizor, supported by Comr. Kesselring, adopt the
following: Resolved by the Calhoun County Metropolitan Planning
Commission recommend the Marshall Township Board approve the rezoning
and map amendment of approximately 1.5 acres located in Section 14
from Agricultural Residential to Highway Service Commercial."
Voice Vote: Motion CARRIED
Case #-1-07-03, Tekonsha Township - Text Amendments Regarding PA
110 of 2006
Ms. Bomba advised that the text amendments presented are to simply
bring the Township's zoning ordinance into compliance with the
consolidation of the Michigan Zoning Enabling Acts. No other amendments
are included. Ms. Bomba recommended the proposed amendments be
recommended for approval by the Tekonsha Township Board.
"Motion by Comr. Rizor, supported by Comr. Millard, adopt the
following: Resolved by the Calhoun County Metropolitan Planning
Commission recommend the Tekonsha Township Board approve the proposed
text amendments to the Township's Zoning Ordinance for compliance with
the new Michigan Zoning Enabling Act."
Voice Vote: Motion CARRIED
Case #01-07-04, Clarendon Township - Map Amendment, Section 11,
Agricultural to Highway Service Commercial
Ms. Bomba advised that the Clarendon Township Planning Commission
received a request from Rick and Mary Nichols to rezone approximately 8
acres located in Section 11 from agricultural to highway service
commercial. Ms. Bomba advised that she has discussed the request with
the Township Planning Commission Chairperson.
Ms. Bomba addressed the map which shows an existing commercial
business, SCM Lumber, located on 3.9 acres, pointing out that it is
zoned agricultural. Ms. Bomba stated that the property along M-60 was
planned for low density residential. Ms. Bomba recommended the amendment
not be recommended for approval as the amendment does not comply with
the County's Master Land Use Plan nor with the Township's Master Land
Use Plan.
Ms. Bomba advised that the Township's Plan dates back to the late
1990's, and that she advised the Township Planning Commission
Chairperson that it is possibly time for the Township Planning
Commission to reassess their Plan.
Comr. Kesselring noted that Mr. and Mrs. Nichols own 13 acres, and
questioned why they have only requested rezoning of 8 acres. Ms. Bomba
advised that the 5 acres in the back will remain zoned agricultural and
that it appears that Mr. and Mrs. Nichols have applied for a division of
that acreage.
Comr. Rizor stated that he is not inclined to allow the dumping of
gray water.
Ms. Bomba again recommended the request for zoning amendment be sent
back to the Township to reassess their development along M-60.
"Motion by Comr. Kesselring, supported by Comr. Rizor, adopt the
following: Resolved by the Calhoun County Metropolitan Planning
Commission recommend the Clarendon Township Board disapprove rezoning
and map amendment of approximately 8 acres located in Section 11 from
Agricultural to Highway Service Commercial based on the inconsistency
of the proposed amendment with the Calhoun County Master Land Use Plan
and with the Township's Master Land Use Plan, and return the requested
amendment back to the Township Planning Commission with the
recommendation that the Planning Commission review the Township's
Master Land Use Plan in regard to development along the M-60
Corridor."
Voice Vote: Motion CARRIED
Comr. Millard stated that his only concern with recommending
disapproval of the request is that the subject property is a viable
business. Ms. Bomba advised that the owners could approach the Township
for a conditional use permit.
STAFF COMMENTS:
Calhoun County Agricultural Preservation Board Report
Ms. Bomba reported that the Agricultural Preservation Board met today
and that Sue Ann Jessup has joined the Board and another candidate is
being considered. Ms. Bomba advised that the Board shall be announcing
the opening of the application cycle for the Purchase of Development
Rights Program and shall be having extensive public relations with the
media. Ms. Bomba stated that the Board hopes to receive a rash of
applications to the Program; and advised that if 75 applications are
received, the Board shall approach the foundations.
2007 Planning Department Budget Discussion
Comr. Rizor inquired regarding the Department's 2007 appropriation.
Ms. Bomba advised that the Department is funded through the year, and
that her agreement has been approved through February 2008.
Comr. Rizor inquired whether there is anything the Planning
Commission can do to promote the trails concept. Ms. Bomba stated that
she envisions the Planning Commission as having more of a supportive
role. Ms. Bomba advised that Annette Chapman who worked on the trails
concept has resigned from the Road Commission to accept a position with
the Battle Creek Foundation.
Chairperson Schubel inquired whether the Department's appropriation
remained the same as last year's. Ms. Bomba responded that the
appropriation increased slightly to allow for some job sharing of
clerical staff through the Extension Department. Ms. Bomba stated that
she shall be assessing how effective it would be to publish a
newsletter.
Ms. Bomba advised that she has been working with Albion Township to
update the Township's Master Land Use Plan. Ms. Bomba stated that the
Township sent out a survey to the residents and she shall be meeting
with the Township's Planning Commission to review the responses.
Ms. Bomba reported that the Department received $2,000 in revenue
from land divisions last year.
Comr. Millard requested a copy of Mr. Cherney's resignation. Ms.
Bomba advised Commissioner Millard that she will provide him with a
copy.
Chairperson Schubel thanked the Members for their vote of confidence
by electing her Chairperson.
ADJOURNMENT:
The meeting adjourned at 5:12 p.m. at the call of the Chairperson.
The next CCMPC meeting is scheduled for February 26, 2007.
